All users and customers of Brand Up Resumes, by the use of Brand Up Resumes’ services, hereby agree to abide by, and acknowledge the following:

*Once proprietary career services materials (including the Brand Up Career Assessment Profile or other guides) have been received by the client, the client may receive a refund of 75% for a cancellation request. All services are non-refundable once the first draft has been delivered. Invoices are valid for up to 30 days of writing services. * Editing services are available for up to 30 days once the first draft has been delivered.

Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall Brand Up Resumes be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, Brand Up Resumes materials. You specifically acknowledge and agree that Brand Up Resumes is not liable for any defamatory, offensive or illegal conduct of any user. You acknowledge that Brand Up Resumes makes no claims or guarantees as to the accuracy or success of its services. If you are dissatisfied with Brand Up Resumes materials, or with any of Brand Up Resumes terms and conditions, your sole and exclusive remedy is to discontinue using Brand Up Resumes.

Brand Up Resumes is not responsible for any inability to access our services, temporary or otherwise. Brand Up Resumes is not responsible for any errors made in our service. By using Brand Up Resumes you acknowledge the fact that not all errors, omissions, and problems can be detected by Brand Up Resumes and its writers/editors. By using Brand Up Resumes, you acknowledge and assume that even after using our editing or writing services, errors might remain in your document(s). Brand Up Resumes is not liable for any of these undiscovered errors. Brand Up Resumes is not responsible for the success of the resumes or career-related products. Brand Up Resumes does not guarantee jobs or employment success. Brand Up Resumes is not responsible for any actions that do or do not result from the use of Brand Up Resumes’ services, including, but not limited to, successful acquisition of a job or the failure to land a job, even on account of Brand Up Resumes’ services.

Notice of the risk of computer viruses. Brand Up Resumes is not liable in any way for any viruses that users of our service may acquire as a result of using our service. We make every attempt to prevent viruses from being transmitted, but by the nature of our activities on the Internet, viruses may be transmitted. Brand Up Resumes is not liable or responsible for any viruses inadvertently transmitted and is not liable for any damages resulting from the transmission of viruses. IN NO EVENT SHALL BRAND UP RESUMES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE.

Brand Up Resumes reserves the right to use prepared documents as marketing documents provided that identifiable details are fictionalized and made anonymous. Furthermore, financial information that is collected on this web site is solely used to process payments for products and services. Financial information is processed through a layered, encrypted SSL secure process and is not retained, nor does it reside on this site.

Termination

We may terminate this license at any time if, in our sole discretion and judgment, you fail to comply with any term or provision of this Agreement. Upon termination, you shall destroy any materials obtained from this web site and all copies thereof, whether made under the terms of this Agreement or otherwise.

Contract Interpretation

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Indemnity

You agree to defend, indemnify, and hold harmless the Brand Up Resumes, its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of the materials or your breach of the terms of this Agreement. Brand Up Resumes shall provide notice to you of any such claim, suit, or proceeding and shall assist you, at your expense and in our discretion, in defending any such claim, suit or proceeding.

Dispute Resolution

Any dispute arising with respect to this Agreement shall be resolved by negotiation between the parties or, if necessary, by resort to an appropriate federal or state court located in the State of Florida. You expressly waive and are estopped from asserting any right to pursue any claim against Brand Up Resumes relating to this Agreement in any forum. In the event of the filing of any such claim, you stipulate to the transfer of the filing to any appropriate or available forum or court in Orlando, FL, at our sole discretion. Use of this web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.
